About these terms

These terms apply to your use of www.whitsundayescape.com and our online booking pages (the website). By using the website, you agree to them.

The website is operated by Whitsunday Escape Pty Ltd ABN 13 098 179 152 trading as Whitsunday Escape (“we”, “us”, “our”).

These terms cover use of the website only. Charter bookings are governed by our Charter Terms and Conditions, which you accept when you book. If the two conflict, the Charter Terms and Conditions apply to your booking.

Website information, prices and availability

Information on the website, including destination, anchorage, vessel and activity information, is a general guide only. Some of it comes from third parties. We take care to keep it accurate and current, but conditions, vessels and inclusions change, and we do not guarantee that everything is complete or up to date.

The website is not a substitute for your charter briefing, current weather and marine forecasts, or official navigation and safety information. Always follow the instructions you receive at your briefing.

All prices are in Australian dollars and include GST unless stated otherwise. Prices, offers and availability may change at any time and are only confirmed once your booking is accepted. If a price is displayed in error, we may correct it before confirming your booking.

Intellectual property and permitted use

The website and its content, including text, photographs, video, maps, logos and the Whitsunday Escape name and trade marks, are owned by or licensed to us and protected by copyright and trade mark law.

You may view, download and print content for your own personal, non-commercial use, such as planning your charter. You must not, without our written permission:

copy, republish or distribute our content, images or video, including on social media, websites or in advertising
use our name, trade marks or images in a way that suggests a connection with, or endorsement by, Whitsunday Escape
use our name or brand in search engine keywords, landing pages or domain names
scrape, harvest or systematically extract content or data from the website
interfere with the website’s operation or security, or use it for any unlawful purpose

To request permission to use our images, contact marketing@whitsundayescape.com. Approved use must credit Whitsunday Escape.

Your photos and posts

We love seeing your charter photos. We may display content from social media (such as Facebook, Instagram and YouTube) on the website and our other channels.

When you post to our official channels, or tag @whitsundayescape or use #whitsundayescape, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, crop, edit and share that content in our online media and social media channels. You keep ownership of your content.

We will credit you on our social media channels where we can. For technical reasons, some content shown on the website may not be credited or reviewed before it appears, and it does not necessarily reflect our views.

By posting, you confirm that you have the right to share the content and that anyone identifiable in it is happy for it to be shared. You can withdraw this licence at any time by emailing reception@whitsundayescape.com, and we will remove the content from the channels we control within a reasonable time. To report content you find inappropriate, contact us at the same address.

Links and liability

Third-party websites. The website links to other sites, including booking, payment, weather and tourism sites. We do not control them and are not responsible for their content, availability or privacy practices.

Availability. We aim to keep the website available and secure, but we do not guarantee it will be uninterrupted, error-free or free of viruses. We may change or suspend the website at any time.

Limitation of liability. To the extent permitted by law, we are not liable for any loss or damage (including indirect or consequential loss) arising from your use of, or reliance on, the website or its content, whether in contract, tort (including negligence) or otherwise.

Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be excluded.

Privacy

We handle personal information collected through the website in line with our Privacy Policy.

Governing law

These terms are governed by the laws of Queensland, Australia. You agree to the non-exclusive jurisdiction of the courts of Queensland.

Changes to these terms

We may update these terms at any time by posting a new version on this page. The version in force when you use the website applies.
